KDV Painting & Decorating Terms and Conditions

The client is responsible for moving or protecting any furniture, valuables, or other items that may be affected by the work, unless otherwise agreed upon in writing.
The client is responsible for obtaining any necessary permits or approvals for the project, unless otherwise agreed upon in writing.

6. Our Responsibilities:

We will perform the services as described in the Project Agreement with reasonable skill and care.
We will use materials of the quality specified in the Project Agreement.
We will adhere to all applicable health and safety regulations.
We will make reasonable efforts to complete the project within the agreed-upon timeframe.

7. Warranties and Guarantees:

KDV Painting & Decorating ("we," "us," or "our") guarantees our workmanship for a period of three (3) years from the date of project completion. This guarantee applies to defects in the application of paint or wallpaper on interior and exterior surfaces of residential and commercial properties.

8. Limitation of Liability:

To the extent permitted by law, our liability for any claims arising out of or in connection with these Terms or the services provided shall be limited to the total amount paid by the client for the specific project in question.
We shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, loss of use, or damage to property.

9. Intellectual Property:

All content on the Site, including text, graphics, logos, and images, is the property of KDV Painting & Decorating and is protected by copyright and other intellectual property laws.

10. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

11. Dispute Resolution:

Any disputes arising out of or in connection with these Terms or the services provided shall be resolved through good-faith negotiations. If the parties are unable to resolve the dispute through negotiation, they agree to attempt to resolve the dispute through mediation. The parties will mutually agree upon a mediator.

12. Entire Agreement:

These Terms, together with the Project Agreement, constitute the entire agreement between you and KDV Painting & Decorating regarding the services provided and supersede all prior agreements and understandings, whether written or oral.

13. Changes to these Terms:

We reserve the right to update or modify these Terms at any time. Any changes will be posted on the Site, and the revised Terms will be effective from the date of posting. It is your responsibility to review these terms periodically for changes.

KDV Painting & Decorating Workmanship Guarantee

What is Covered:

This guarantee covers the following defects in workmanship:

Peeling, blistering, or flaking paint that is not caused by underlying substrate issues (see exclusions below).
Uneven paint coverage, runs, drips, or sags.
Poorly hung wallpaper, including visible seams, bubbles, lifting, or misalignment.
Incorrect surface preparation that directly leads to paint or wallpaper failure within the guarantee period.

What is Not Covered:

This guarantee does not cover the following:

Material Defects: Problems with the paint, wallpaper, or other materials themselves (e.g., premature fading, cracking due to a manufacturing fault) are covered by the manufacturer's warranty, not KDV. We will assist you in making a claim with the manufacturer if such a defect occurs.

Underlying Surface Issues: Problems that arise due to pre-existing or underlying issues with the surfaces being painted or papered, including but not limited to:

Dampness, moisture, or leaks.
Cracking, crumbling, or unsound plaster.
Rotten or damaged wood.
Previous paint or wallpaper failure.
Structural defects.

Normal Wear and Tear: Normal wear and tear, including scuffs, chips, fading due to sunlight, or other damage caused by everyday use, is not covered.

Client-Supplied Materials: If the client supplies the paint, wallpaper, or other materials, this workmanship guarantee applies only to the application of those materials, not the materials themselves.

"Acts of God" or Accidents: Damage caused by events outside of KDV's control, including but not limited to:

Natural disasters (e.g., storms, floods, earthquakes).
Fire, vandalism, or accidents.
Damage caused by the client or third parties.

Maintenance: This guarantee does not cover the cost of routine maintenance, such as cleaning or touch-ups.

Claim Process:

If you believe you have a valid claim under this workmanship guarantee, please contact us in writing within [Number] days of discovering the defect, providing the following information:

Your name and contact information.
The address of the property where the work was performed.
A detailed description of the defect.
Photographs of the defect.
A copy of your contract or invoice.

We will then inspect the defect and determine whether it is covered by this guarantee. If the claim is valid, we will, at our discretion, either repair the defect or re-perform the affected work at no cost to you.

Limitations:

This workmanship guarantee is non-transferable and applies only to the original client who contracted for the services. Our liability under this guarantee is limited to the cost of the original work performed.
